There were several new employment laws passed in recent years that provide employees with further protection against discrimination, but what are the most common reasons employees decide to file a discrimination complaint? You may have a claim you don’t even know about. I will cover a few basics here, but if you think you may have a case, the team at UELG is waiting to help.

Most cases of discrimination are a simple matter of action or inaction in disproportionate amounts. In other words taking action against a specific person or group or failing to act when a supervisor or coworker has acted unjustly.

Some of the most likely reasons for filing an EEO or discrimination complaint include:

• Communication failures or misunderstandings, this could easily be avoided, but often escalates.

• Unequal treatment of certain groups, whether real or perceived.

• Supervisors who fail to or refuse to address problems reported by their employees.

• Sudden changes to policy or practice that seem to target a specific person or group.

• Low employee morale and general resentment within the company.

• Personal issues among employees or supervisors.

• Favoritism and or bias given to a certain person or group, real or perceived.

As the Great Cool Hand Luke put it a, “FAILURE TO COMMUNICATE” can cause bit problems. If you are in a workplace with supervisors who let all the blame for poor management fall on you or your coworkers it can spell bigger problems.

While we all have a bad day from time to time, it’s probably quite clear if there is a true discrimination issue in your workplace. With all of the protections afforded employees in California these days there is no reason for you to just keep quiet and bear it. No matter who you are you are protected from unfair treatment at work.
