California overtime laws contain all the important labor protection laws. Overtime laws consist of statutes; rules and regulations which govern the compensation of employees residing in California or working here. California overtime law is present in the California Labor Code and in Wage Orders<\/a>. A  California employee is required to comply with both the codes.<\/p>\n

According to California Labor Code, a relationship of employer and employee is very necessary for the application of overtime law. According to the California Wage Orders, an employer is a person who employs a person or persons or exercises control over the wages, hours and working conditions of his employee. According to California Labor Code, an employee is any person rendering actual service for the employer, whether gratuitously or for wages or pay. <\/span><\/p>\n

According to California Labor Code, employees who fall under the non-exempted category should be compensated at one and a half times the normal rate of pay for all those hours for which they have worked more than eight hours in a workday and forty hours in a work week. California overtime laws are different from federal overtime laws. California law entitles the employees to double-time pay for working more than twelve hours on workdays or more than eight hours on the seventh consecutive workday of a single workweek.<\/span><\/p>\n

Many conflicts arise between the employees and employers because of the eight hour overtime limit and many litigation suits are filed for breach of the labor law. Employees working in California need expert advice in matters of their rights being violated and their overtime pay not given to them. Most of the times issues arise where employers tell employees that since they have worked certain hours on some day like 11 hours then they can adjust those hours the next day and work for less hours on Tuesday. This results in non-payment of their overtime wages and gross injustice to them. Every employee working in California is entitled to overtime wages according to the rules given in the California Labor Code and Wage Orders.<\/span><\/p>\n
