3 Rights You need To Claim
Employers Cannot Trample Your Rights –
Millions of people go to work daily dreading their workday. They are abused and they are pushed to the brink of quitting, but they can’t. The problem that most people have is not so much that they have a job that is miserable, but that they don’t know they have rights. Some bosses abuse the system and until someone speaks up, nothing changes. In California, as well as the rest of the nation, there are laws in place that are nonnegotiable and should not be taken for granted. When workers fail to speak up about the abuses that their employers mandate, the system fails. If you’re not sure what your rights are, then perhaps it’s time to look at a few key issues that you may be facing today.
Working Through Lunches
In any arena, you should not have to work through your lunch break. If you’re working through a lunch because you are told you cannot leave, or you cannot clock out, you are not being treated fairly. An employer has to allow you to have a lunch break in which you do not have to sit at your desk and work. If you are not allowed to leave and you are working 8 hour shifts, with no breaks, or no time away from your desk to eat lunch, there is something wrong.
Sexual Harassment
No matter what you look like, how you dress, an employer cannot talk to you in a sexual manner. Even if it is a joke, there is no indirect or direct language that is appropriate in the workplace if it is of a sexual nature. This also includes any form of touching, harassment, or abuse. There are some workplaces that can seem “loose” with the rules, and some people that can say they have a certain “rapport” with others, but if it is of a sexual nature and it is not comfortable to listen to or respond to at all, it should be reported. Often times these egregious comments and jokes are unreported and go too long without any sort of reprimand. The law is on your side as an employee and this should not be tolerated at all.
No Overtime Pay
Some companies force their employees to clock out and still stick around to work. Others will only pay for the 8 hours and that’s it. If you’re working past 8 hours, if you’re working on a holiday, if you’re clocking out and forced to stay, there’s something wrong. Overtime is meant for hours that are over the 8 hour shift and should not be taken away from you.
These are just some of the worker rights that should not be taken for granted or taken away. Do not allow any employer to trample these rights, make sure that you brush up on the aforementioned and be careful when in the work place.
